PerfectPrenup.io - Terms of Use

These Terms of Use ("Terms") govern your access to and use of perfectprenup.io (the "Site") and the prenuptial agreement templates and related content made available through it (collectively, the "Service"). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. NOT A LAW FIRM; NO LEGAL ADVICE; NO ATTORNEY-CLIENT RELATIONSHIP
PerfectPrenup.io is not a law firm, is not a lawyer or lawyer referral service, and does not provide legal advice. The Service is an educational self-help tool. No attorney-client relationship is formed by your use of the Site. Communications with us are not privileged or protected as attorney work product.
2. NATURE OF THE TEMPLATES
The prenuptial agreement templates provided through the Service are prepared with the assistance of artificial intelligence tools, including large language models, and are reviewed against applicable state statutes and case law to address provisions commonly scrutinized by courts. Templates are educational starting points, not finished legal documents.
You acknowledge and agree that:
(a) prenuptial agreements are complex legal instruments with significant and potentially permanent financial and legal consequences;
(b) state laws governing prenuptial agreements vary significantly and change frequently;
(c) some states require independent legal counsel for enforceability of certain provisions (for example, California requires independent counsel for waivers of spousal support);
(d) you must have any template reviewed, modified, and finalized by a licensed attorney in your state of residence before signing — we recommend an attorney whose practice focuses on family or matrimonial law with at least ten (10) years of experience;
(e) signing a template without independent attorney review materially increases the risk that the resulting agreement will be invalid, unenforceable, or set aside.
3. NO GUARANTEE OF RESULTS
We make no representation or warranty regarding the validity, enforceability, or legal effect of any template, any agreement derived from a template, or any outcome in any proceeding. Whether a prenuptial agreement is enforced is a fact-specific determination made by a court applying the law of the relevant jurisdiction.
4. AI-GENERATED CONTENT
You acknowledge that AI-generated content may contain errors, omissions, or outdated information. The Service is not monitored in real time and is not updated on any guaranteed schedule. You agree not to rely on the Service as a substitute for advice from a licensed attorney.
5. ELIGIBILITY
You must be at least 18 years old and able to form a binding contract. The Site is intended only for users located in the United States. Do not use the Site if you are under 18 or located outside the United States.
6. USER RESPONSIBILITIES
You agree to:
(a) retain a licensed attorney in your state to review and modify any template before signing;
(b) independently verify all legal, tax, and financial implications;
(c) comply with all execution requirements of your state, including any mandatory waiting periods, disclosure requirements, and witness or notarization requirements;
(d) accept full responsibility for your use of any template.
7. THIRD-PARTY LINKS
The Site contains links to third-party websites, including attorney directories such as Avvo and similar services, to help you locate independent counsel. We do not endorse, recommend, or vouch for any attorney, directory, or third-party site. We make no representation regarding the qualifications, competence, or fitness of any attorney listed on any third-party site. Your use of any third-party site is at your own risk and governed by that site's own terms and policies.
8. INTELLECTUAL PROPERTY
All templates, content, code, design, and materials on the Site are the property of PerfectPrenup.io LLC or its licensors and are protected by copyright, trademark, and other laws. You are granted a limited, personal, non-transferable, non-exclusive, revocable license to access and view the Site and to download, print, and use a single template for your own personal, non-commercial preparation of a prenuptial agreement.
You may not:
(a) reproduce, distribute, sell, sublicense, publicly display, or create derivative works from the templates or other Site content;
(b) remove or alter any copyright, trademark, or other proprietary notices;
(c) scrape, crawl, or use automated means to access or extract content from the Site;
(d) use any template, content, or other material from the Site to train, fine-tune, evaluate, test, or otherwise develop any artificial intelligence or machine learning model, or permit any third party to do so.
9. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL TEMPLATES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, CURRENCY, LEGAL VALIDITY, OR ENFORCEABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PERFECTPRENUP.IO, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, ASSETS, PROPERTY, OR OPPORTUNITY, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) ONE HUNDRED DOLLARS ($100) OR (ii) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless PerfectPrenup.io and its owners, members, managers, employees, contractors, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site or any template; (b) any prenuptial or postnuptial agreement you sign; (c) any dispute with your spouse, partner, or any third party; (d) your failure to obtain independent legal counsel; (e) your violation of these Terms or any applicable law; except to the extent caused by our gross negligence or willful misconduct.
12. BINDING ARBITRATION; CLASS ACTION WAIVER
You and PerfectPrenup.io agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in Wilmington, Delaware or, at your election, in your county of residence. The Federal Arbitration Act governs this provision.
YOU AND PERFECTPRENUP.IO EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding. Either party may bring an individual claim in small claims court if it qualifies. This Section survives termination of these Terms.
13. NOTICE OF DISPUTE
Before initiating arbitration, you must send written notice of the dispute to hello@perfectprenup.io, describing the claim and the relief sought. The parties will attempt in good faith to resolve the dispute for sixty (60) days before either may commence arbitration.
14. TIME TO BRING CLAIMS
Any claim arising out of or relating to these Terms, the Site, or the Service must be filed within one (1) year after the claim arose. Claims not filed within that period are permanently barred.
15. GOVERNING LAW; VENUE
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any proceedings not subject to arbitration must be brought exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction in those courts.
16. REFUNDS
All sales are final, except where required otherwise by applicable law.
17. CHANGES TO THESE TERMS
We may modify these Terms at any time by posting an updated version on the Site. The updated Terms take effect on the date posted. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms.
18. STATE-SPECIFIC PROVISIONS
North Carolina Residents: The disclaimers of warranties and limitations of liability in these Terms do not apply to you to the extent prohibited by North Carolina law, and these Terms will not require you to litigate or arbitrate outside North Carolina.
California Residents: Under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
19. NO THIRD-PARTY BENEFICIARIES
These Terms confer no rights on any person or entity other than you and PerfectPrenup.io. No spouse, partner, fiancé(e), beneficiary, heir, or other third party is an intended beneficiary of these Terms.
20. FORCE MAJEURE
We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including outages of third-party hosting, AI, payment, or infrastructure providers, internet disruptions, acts of God, natural disasters, government actions, war, terrorism, pandemic, or labor disputes.
21. DMCA NOTICES
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. Send notices to: hello@perfectprenup.io. Notices must include the information required by 17 U.S.C. § 512(c)(3).
22. SEVERABILITY
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
23. ENTIRE AGREEMENT; ASSIGNMENT
These Terms, together with the Privacy Policy, constitute the entire agreement between you and PerfectPrenup.io regarding the Site and Service and supersede any prior agreements. You may not assign these Terms. We may assign these Terms without restriction.

FINAL NOTICE: TEMPLATES MUST BE REVIEWED AND FINALIZED BY A LICENSED ATTORNEY IN YOUR STATE BEFORE SIGNING. WE ACCEPT NO LIABILITY FOR ANY CONSEQUENCES OF USING ANY TEMPLATE WITHOUT INDEPENDENT ATTORNEY REVIEW.
